‘Dismantling of Jammu and Kashmir’ deals with all the aspects of the ‘Kashmir Question’, which is analyzed by several eminent scholars. Unable to prevent the physical and the political disintegration of his kingdom the Maharaja decided to merge Jammu and Kashmir in India on October26, 1947 by signing the ‘Instrument of Accession’. The merger was done on the basis of providing certain privileges such as the Article 370 and guarantees made as a part of the constitution. Thus, the merger took place under an agreement between the two sovereign nations, India and Jammu & Kashmir. Abrogating the Article 370 and the consequent Article 35A of the Indian Constitution and dismantling the state of Jammu and Kashmir and making it as two union territories was an authoritarian assault on democracy and federalism. Jammu and Kashmir is not the only state, which is protected by the Indian Constitution with special status.
